am adopting a rescued cat/kitten from Four Paws and Tail  on  (date) ______________________________________________

Four Paws and Tail will deliver custody and possession of this animal to owner on the condition that the owner will meet the terms with all of the following:

§  If, for any reason, owner should not be able to keep this cat, owner is obligated to return the cat to FOUR PAWS AND TAIL.  Owner may NOT release ownership of this animal to any other person or agency without consent from FOUR PAWS AND TAIL.

§  Owner acknowledges the right of any officer or agent of FOUR PAWS AND TAIL to immediately remove the animal from the owner’s premises if any of the following conditions or promises is violated.  Owner further grants permission to any officer or agent of FOUR PAWS AND TAIL to enter the owner’s premises at any time to investigate compliance with the below listed terms and/or for the purpose of retaking possession, custody and ownership of the animal.  In each case entry shall not constitute a trespass.  Furthermore, owner promises to surrender the animal and ownership to said individual or agent upon demand.

§  Owner promises:

§  To have this cat spayed/neutered by (cats can be fixed at 9-12 weeks old or 2.5-3lbs) 6 months of age, unless medically contra-indicated.

ü  To keep this animal as a house pet and companion and to keep the cat strictly indoors and not to de-claw the cat under ANY circumstances.

ü  Owner agrees to pay to FPTR the sum of $1,000 if the owner defaults on this contract and de-claws the cat.

ü  Owner agrees to pay all vet care bills if this animal is sick or injured and if FPTR is contacted and the cat has been found outside, the owner will immediately, forfeit ownership for breach of contract. There will be a $200.00 return fee for this pet.

ü  To provide proper food, shelter, water and humane treatment for this animal at all times;

ü  To make every effort to recover a lost animal, and to immediately notify FOUR PAWS AND TAIL in the event the animal is lost, stolen or dies or if the owner’s address or phone number changes.

ü  To immediately procure veterinary care, if the animal is sick or injured, and obtain all necessary inoculations annually, or, to immediately return the animal to FOUR PAWS AND TAIL

ü  NOT to use the cat for hunting purposes AND fighting purposes, this will result in IMMEDIATE removal of the animal.

§  Liquidated damages, attorney fees and court costs:

ü  Owner agrees to pay FOUR PAWS AND TAIL the sum of $400 as liquidated damages in the event the terms of this contract were wrongfully breached by owner.  Owner agrees to pay reasonable attorney fees and court costs in the event this matter requires the services of an attorney for FOUR PAWS AND TAIL to enforce the terms and conditions of this contract.

§  There will be no refunds of donations or other expenses incurred by owner if cat is returned to FOUR PAWS AND TAIL.

§  Owner understands that FOUR PAWS AND TAIL makes no representation, warranty, or guarantee as to the size at maturity, health or disposition of any cat because FOUR PAWS AND TAIL is uncertain of its background.  FOUR PAWS AND TAIL inquires of known owners whether their animal bites, otherwise FOUR PAWS AND TAIL makes no representation, guarantee or warranty that the animal does not bite.  Owner also understands that the cat has displayed no evidence of illness or health problems during its stay with FOUR PAWS AND TAIL, except for those disclosed in the Comments section below.

I understand that by signing this contract, I am taking sole responsibility of the rescue animal.  Four Paws and Tail is not liable or responsible for any damage to persons or property once this contract is signed.  I am signing and adopting the animal of my own free will and not under duress of any kind.  If the animal is being neglected or abused, Four Paws and Tail reserves the right to reclaim the cat immediately.

OUR ADOPTION CONTRACT IS NOT MEANT IN ANY MEANS TO INVADE YOUR PRIVACY, OFFEND YOU IN ANY WAY OR MAKE YOU FEEL UNCOMFORTABLE.

OUR CONTRACT IS INTENDED TO PROTECT OUR BELOVED RESCUED CATS AND KITTENS. EACH KITTEN AND CAT THAT COMES THROUGH OUR RESCUE IS PART OF OUR FAMILY.

WE WANT TO ENSURE THE CATS ARE GOING TO HOMES THAT WILL PROPERLY CARE FOR THEM.

WE DO NOT ENTER ANY ONES HOME OR TAKE BACK THE CAT IF THE VET CARE ISN'T UPDATE OR ANYTHING LIKE THAT.

THE LINE ABOVE THAT ALLOWS US TO ENTER HOMES IS MEANT ONLY IF A CAT/ KITTEN HAS BEEN LIVING IN UNSANITARY CONDITIONS, HAS BEEN NEGLECTED OR ABUSED. ONLY IN EXTREME CIRCUMSTANCES. WE HAVE NEVER HAD THIS HAPPEN IN THE YEARS WE HAVE BEEN DOING THIS.

ONCE YOU SIGN THE CONTRACT THE CAT/KITTEN IS YOURS.

OUR CONTRACT AGAIN IS MEANT TO
